How I collect, use, store and share personal information, and how you can see it, fix it or complain.

About this policy

This policy explains how Switched On AI collects, uses, stores and shares personal information, and how you can see it, correct it or make a complaint. Personal information is information that identifies you, or could reasonably be used to identify you, like your name, phone number, email address or the sound of your voice on a recording.

Switched On AI is the business name of Viraj (Viri) Uyana Hewage, a sole trader based in Morayfield, Queensland. We build websites, AI chat assistants, AI phone receptionists, text messaging, online booking and review requests for local small businesses. In this policy, "we", "us" and "our" mean Switched On AI.

Most small businesses with an annual turnover of $3 million or less don't have to follow the Privacy Act 1988 (Cth). We're a small business, so we may not have to either. We still follow the Australian Privacy Principles (APPs) as good practice, and we've written this policy to match them.

Some laws apply to every business, no matter how small. These include the Spam Act 2003, the rules for telemarketing calls, the laws on recording phone calls, and the right people have to sue for a serious invasion of privacy. We follow those too.

How to contact us

The short version

  • We collect contact details that businesses have published themselves, and details people give us when they contact us or become clients.
  • We use them to talk to businesses about our services, to do the work, and to get paid.
  • The chat on our website and the assistant that answers our phone are AI. They tell you that at the start. Calls the AI assistant answers are recorded and transcribed.
  • Our systems are run by service providers, mostly in the United States, and some support staff are in India.
  • We don't sell personal information, and we don't use it to train AI.
  • You can opt out of our messages at any time. Reply STOP to a text, reply to an email, or tell us.
  • You can ask to see or correct your information, or make a complaint, by emailing viri@switchedonai.com.au.

What information we collect

Businesses we'd like to work with

We look for local businesses that might want a new website or AI assistant. For these businesses we collect:

  • the business name, ABN, address or suburb, opening hours, services and prices it has published
  • the owner's or contact person's name
  • the business phone number and email address it has published
  • its website and social media pages
  • photos the business has published, and its public star rating
  • a record of where and when we found the contact details
  • notes about our contact with the business, such as when we called or emailed, what was said, and whether the business asked us not to contact it again.

People who contact us

When you get in touch through our website form, the chat on our website, a phone call, a text, an email or a social media message, we collect:

  • your name and business name
  • your phone number and email address
  • what you ask about and the messages you send us
  • a written copy (transcript) of any chat with our AI assistant
  • a recording and a transcript of any call our AI assistant answers
  • the phone number you called or texted from, and the time and length of calls and texts.

Our clients

When a business becomes our client, we also collect:

  • the contact person's name, phone number and email address, and the business's name, ABN and address
  • the content we need to build and run your services, such as text, photos, your logo, prices, hours, service areas and the information your AI assistant uses to answer questions
  • logins or access you give us, such as for your domain name, Google Business Profile or social media pages
  • signed order forms and agreements
  • records of change requests, support requests and our messages with you
  • invoices and payment records.

Our clients' customers' information is handled differently. See "If you're a customer of one of our clients".

Payments

Card payments are processed by Stripe through our client hub. We see the details we need for our records, like the amount, the date and the name on the card, but we don't see or store your full card number. If you pay by bank transfer, we see the account name and reference that show on our bank statement.

Our website

Our website uses cookies and similar technology so that the site, the contact form and the chat work properly. Our website platform also records basic information about visits, such as the pages viewed, the type of device and browser, the rough location worked out from your internet address, and the time of the visit. We use this to see how the website is going and to keep it secure. We don't use it to work out who you are. You can block or delete cookies in your browser settings, but parts of the website, like the chat, may not work properly.

Sensitive information

We don't ask for sensitive information, such as health information. Please don't share it with our AI assistant, in our forms or in texts. Please don't share card numbers or passwords there either. If you do send us sensitive information, we'll only use it to deal with your enquiry, and we'll delete it once we don't need it.

How we collect it

We collect personal information:

  • from public business listings and pages the business published itself, such as Google Maps and Google Business Profiles, the business's own website, its Facebook page, and the public ABN Lookup register
  • from you, when you contact us, talk to us, fill in a form, chat with our AI assistant, sign an order form or send us content
  • through our AI assistant and phone system, which record and transcribe calls and save chats
  • from our service providers, for example when Stripe tells us a payment has been made
  • from other people, for example when someone refers you to us
  • from our website, through cookies and visit records.

We collect business contact details by hand. We don't use scraping tools, and we don't buy contact lists.

Why we use it

We use personal information to:

  • contact businesses about our services, including sending a free preview website or chat assistant (see "Free previews we make for businesses")
  • answer enquiries and prepare quotes
  • build, host and look after websites, and set up and run AI assistants, text messages, booking and review requests for our clients
  • send invoices, take payments and keep business and tax records
  • keep our do-not-contact list, so we don't contact people who've asked us to stop
  • check that our AI assistant is giving the right answers, and improve our services and website
  • show websites we've built in our portfolio, unless the client asks us not to
  • keep our systems secure and stop fraud or misuse
  • deal with complaints and disputes, and meet our legal obligations.

We only use your information for something else if you agree, if you'd reasonably expect us to, or if the law requires or allows it.

Contacting businesses about our services

We find local businesses on Google Maps and similar public listings. We may email, text or call a business about our services, using contact details the business itself has published for business use, such as on its Google Business Profile, its own website or its Facebook page.

  • We only send messages that are relevant to the business, such as about its website.
  • We don't use contact details if the business has said it doesn't want sales messages.
  • Every email and text we send says it's from Viri at Switched On AI, gives our contact details and tells you how to opt out.
  • If Viri calls, he'll say who he is, the business name and why he's calling, and his caller ID will be on. He only calls on weekdays from 9am to 8pm and Saturdays from 9am to 5pm, never on Sundays or public holidays, and he'll end the call if you ask.

Marketing and how to opt out

You can tell us to stop contacting you at any time. Any of these work:

  • reply STOP to any text from us
  • reply to any email from us and say "unsubscribe" or "no thanks"
  • tell Viri on the phone
  • email viri@switchedonai.com.au.

It's free. We'll stop within 5 working days, and usually the same day. We'll add you to our do-not-contact list, which covers email, text and phone calls. We keep only what we need on that list (the business name and the contact details you asked us not to use) so we can make sure we don't contact you again.

If you're a client, we'll still send you messages about the services you've bought from us, such as invoices, updates and anything we need you to know.

Free previews we make for businesses

Sometimes we make a free preview website or chat assistant for a business before we contact it, to show what we could do. We build it from public information about the business, such as its name, services, hours, service area, contact details and photos it has published.

  • Every preview says it was made by Switched On AI and is not the business's official website.
  • Previews are on a private link and are set so they don't show up on Google.
  • Previews don't have working enquiry forms, and a preview chat assistant says it's a demo.
  • We don't copy customer reviews word for word or show reviewers' names. We summarise what reviews say and link to them instead.
  • We only use the business's photos in the private preview.
  • We take a preview down within 24 hours if the business asks us to. If the business doesn't go ahead, we take it down and delete it after 14 days.

Our AI assistant

The chat on our website and the assistant that answers our phone when Viri can't are AI assistants, not people.

  • They tell you they're an AI assistant at the start of every chat and call.
  • Calls the AI assistant answers are recorded and transcribed (written down). It tells you this at the start of the call. If you'd rather not be recorded, you can hang up and text or email us instead.
  • Chats are saved as written transcripts.
  • The assistant answers common questions about our services, takes your name, number and what you need, and passes it all to Viri.
  • Viri reads the transcripts and follows up. The AI doesn't make decisions about you. Quotes, prices and anything we agree to come from Viri.
  • AI can make mistakes. If something the assistant tells you matters to you, please check it with Viri.
  • The assistant runs on HighLevel and uses AI providers, such as OpenAI, to understand what you say and reply.
  • We don't use your conversations to train AI models. Where a provider lets us switch off the use of our data for training, we switch it off.
  • We don't publish or share recordings or transcripts, and we never use them in our marketing or demos.

Who we share information with

We share personal information with the service providers that run our systems, only so they can provide their service to us. They are:

We may also share personal information:

  • with our accountant, lawyer or insurer, if they need it to advise us
  • when the law requires or allows us to, for example to a court or a government agency.

We don't sell or rent personal information, and we don't give it to other businesses for their marketing.

Information stored or accessed overseas

Some of the providers above store or access information outside Australia. Most of it is stored in the United States, and some HighLevel support staff are in India. Information may also be handled in other countries where these providers operate. We use established providers, we check their security and privacy terms, and their terms limit how they can use the information. Where a provider lets us switch off the use of our data to train its AI, we switch it off.

How we store and protect it

We hold personal information electronically, in the online systems listed in "Who we share information with". We take reasonable steps to keep it safe from misuse, loss and unauthorised access:

  • We use two-step login (multi-factor authentication) on our accounts wherever it's available, and strong, unique passwords.
  • Right now Viri is the only person in our business with access to our systems. If anyone else helps us in future, they'll have their own login and only see what they need.
  • We don't keep call recordings or data exports on our own devices for longer than we need them.
  • Our main providers use security such as encryption when information is sent and stored.

No system is perfectly secure. If we have a data breach that is likely to cause you serious harm, we'll tell you as soon as we can, explain what happened and what you can do.

When we no longer need personal information, we delete it or remove the parts that identify you.

Dealing with us without giving your name

You can look at our website and ask general questions in the chat without telling us who you are. If you want a quote, a call back or our services, we'll need your name and contact details.

Seeing and correcting your information

You can ask to see the personal information we hold about you, or ask us to correct it. Email viri@switchedonai.com.au or call 0451 630 068.

  • It's free.
  • We may need to check who you are before we give you any information.
  • We'll respond within 30 days.
  • If we can't give you access, for example because it would affect someone else's privacy or the law doesn't allow it, we'll tell you why in writing.
  • If your information is wrong, out of date or incomplete, we'll fix it. If we don't agree that it's wrong, we'll tell you why and, if you ask, add a note of your view to our records.

Making a complaint

If you're unhappy with how we've handled your personal information, please tell us first. Email viri@switchedonai.com.au with what happened and what you'd like us to do. We'll look into it and give you a written answer within 30 days.

If you're not happy with our answer, you may be able to complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au. The OAIC can only deal with complaints about businesses covered by the Privacy Act, so it may not be able to take a complaint about us. For complaints about unwanted emails, texts or calls, you can also contact the Australian Communications and Media Authority (ACMA) at acma.gov.au.

If you're a customer of one of our clients

We build and run websites, chat assistants, AI phone receptionists, text messages, online booking and review requests for local businesses. If you've called, texted, chatted with, booked with or been asked for a review by one of those businesses, your information was collected by and for that business.

  • That business is responsible for your information and decides how it's used. Its own privacy policy explains how it handles it.
  • We handle the information only on the business's behalf, to run the services for it, following its instructions.
  • We don't sell it, use it for our own marketing or use it to train AI.
  • It's stored with the providers listed in "Who we share information with", mainly in the United States.
  • Call recordings are kept for 90 days unless the business chooses a different period. When the business stops using our services, we delete its customers' information within 90 days, unless the business asks us to move it to its own account or the law requires us to keep it.

Please contact the business first with any question, request or complaint about your information. If you contact us instead, we'll pass it on to the business within 5 business days and help them respond.

Changes to this policy

We may update this policy from time to time, for example when we start using a new service provider. The latest version is always at switchedonai.com.au/privacy, with the version date at the top. If a change affects how we handle our clients' information, we'll let our clients know.
