About these terms

These terms apply when you use our website at switchedonai.com.au, including the chat assistant on it. The website is run by Switched On AI, the business name of Viraj Uyana Hewage (ABN 48 372 445 638), a sole trader based in Morayfield, Queensland. In these terms, "we", "us" and "our" mean Switched On AI.

By using the website, you agree to these terms. If you don't agree, please don't use the website.

If you buy services from us, your order form and our Client Terms of Service at switchedonai.com.au/terms apply to those services. If anything in these website terms is different from your order form or the Client Terms of Service, the order form and the Client Terms of Service apply.

Information on this website is general

The information on this website is general information about us and our services. It isn't legal, financial, marketing or technical advice for your business. We try to keep it accurate and up to date, but we can't promise everything on it is complete or current. If something matters to your decision, please check it with us.

We don't promise any particular result from our services, such as more calls, bookings, sales or a higher Google ranking.

Prices

• Prices on the website are in Australian dollars. Our prices don't include GST because Switched On AI is not registered for GST.
• Prices on the website can change. The price you pay is the price in the order form you sign. Once you've signed an order form, the setup prices in it are fixed.
• How monthly fees can change is set out in our Client Terms of Service, under "Changes to prices".
• A price shown as "from" is a starting price. The final price depends on what you need, and we'll confirm it in writing before you agree to anything.

Examples and demos

• The website may show examples of our work, sample websites and demo assistants. Sample websites and demos may use made-up business names and details to show how things work, and we label them as samples.
• We show websites we've built for clients as examples of our work. The business names, logos, photos and details on those websites belong to those businesses.
• Sometimes we make a free preview website or chat assistant for a particular business. A preview is on a private link, says it's made by Switched On AI, and is not that business's official website. If you come across one, please don't rely on it. Contact the business directly.
• Results for one business are not a promise of the same results for yours.

Our AI chat assistant

• The chat on our website is an AI assistant, not a person. It can answer common questions about our services and take your details for Viri.
• AI can make mistakes. The assistant might misunderstand you or give an answer that's wrong, incomplete or out of date.
• What the assistant says is general information only. It isn't advice, and it isn't a quote or an offer. Prices, timing and anything we agree to are only confirmed when Viri confirms them in writing, in a quote or an order form.
• Please don't share card numbers, passwords or health information in the chat.
• Chats are saved and Viri reads them. Our Privacy Policy explains how we handle them.

Links to other websites

Our website may link to other websites, such as Google, our clients' websites and our suppliers' websites. We don't control those websites and we're not responsible for their content, their privacy practices or whether they're available. A link doesn't mean we recommend or endorse the website or business.

Our content, name and logo

The content on this website, including the text, design, graphics, images, videos and code, and the Switched On AI name and logo, belong to us or to the people who have given us permission to use them. Some images and content belong to others, such as our clients and stock photo libraries, and we use them under licence or with permission.

You can look at the website, share links to it, and print or save pages for your own use or to think about using our services. You must not copy, republish, sell or change our content, or use our name or logo, without our written permission, except where the law allows it.

Using the website properly

When you use the website or the chat assistant, you must not:

• use them for anything unlawful, misleading or harmful
• try to get into parts of the website or our systems you're not allowed to, or get around our security
• upload or send viruses or other harmful code
• use bots, scrapers or other automated tools to copy content or collect information
• send spam or fake enquiries through our forms or chat
• pretend to be someone else or give false details
• try to make the chat assistant produce unlawful, harmful or offensive content, or use it to collect information about other people
• overload or disrupt the website.

We may block anyone who breaks these rules from using the website or the chat assistant.

Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or changes any rights or remedies you have under the Australian Consumer Law, or under any other law that can't be excluded.

Limits on our liability

The website is free to use. We take reasonable care with it, but we can't promise it will always be available, error-free or free of viruses. Please use your own virus protection.

As far as the law allows, we're not liable for any loss or damage, including indirect loss such as lost profits, that comes from:

• using the website, or not being able to use it
• relying on the general information on the website or the chat assistant's answers
• using websites we link to.

This doesn't limit our liability for fraud or for anything else the law says can't be limited. Our responsibilities for services you buy from us are set out in our Client Terms of Service and your order form.

Privacy

We handle personal information collected through the website, including through the contact form and the chat assistant, as set out in our Privacy Policy at switchedonai.com.au/privacy.

Changes to these terms

We may update these terms from time to time. The latest version is always on the website, with the version date at the top. A change applies from the date we publish it. It doesn't change anything you've already agreed with us in a signed order form.

Queensland law

Queensland law applies to these terms. If you have a problem with the website, please talk to us first and we'll try to sort it out. Any legal dispute about these terms can be heard by the courts and tribunals of Queensland.
